Empire State Building might be part of public firm (AP)

NEW YORK ? Even King Kong might go ape over this possible business deal: The Empire State Building could become part of a publicly traded real estate investment company.

Malkin Holdings LLC., the family-owned company that supervises the portfolio of office properties that includes the iconic Manhattan skyscraper, is weighing that possibility, according to a filing with the Securities and Exchange Commission on Tuesday.

The filing, called an 8-K, does not necessarily mean that an initial public offering is imminent or even likely.

Scott Sweet, a senior managing partner at IPO Boutique, said the 8-K filing is rare, and could be an attempt at a trial balloon or simply as a method of informing potential investors and traders. It also might be a means to communicate with shareholders that something is afoot.

"They're going through the legal channels of announcing there could be something happening and are making it clear what it could be," he said.

In the one-paragraph filing, the company said it could not disclose further information at this time because of legal reasons.

But the company said in the filing that more information could be forthcoming in about three months.

The company echoed its filing in a statement emailed to The Associated Press.

It declined to answer specific questions about any possible public offering.

The Empire State Building, a 102-story tower completed in 1931, is famous for its rooftop view and for its role as the building that the giant ape scaled in the 1933 film "King Kong."

Earlier this year, the building announced it was completing a $550 million renovation project with the replacement of its elevators.

Xbox 360 shatters its own sales records (Digital Trends)

Retailers and manufacturers around the world are likely breathing a sigh of relief before going off to count their new piles of cash that are hopefully being delivered in the form of gold coins that people can swim in, ala Scrooge McDuck. While that probably isn?t likely (or physically possible), there is no denying that the sales results from Black Friday and the beginning of the official holiday rush are impressive.

In general, the sales on Black Friday have been somewhat incredible, as retailers are posting figures that are nearly 25-percent higher than this time last year, and that is only an early estimate. Sales records are being shattered like an iPhone during a flight, as individual products are also posting record sales figures.

Amazon has reported that the Kindle Fire has quadrupled its sales, while Nintendo set records thanks to the timely release of Super Mario 3D Land for the 3DS and The Legend of Zelda: Skyward Sword for the Wii. Not to be outdone in the electronics field, Microsoft has also announced that it sold more Xbox 360s last week than in any other week in the console?s six year history.

During the week of Black Friday, Microsoft has confirmed that it moved 960,000 consoles in the U.S. alone, and 800,000 of those were sold within a 24-hour period. It is also reporting that 750,000 Kinect sensors were sold, both alone and as part of a bundle.

Microsoft is pushing the Xbox 360 and the Kinect hard this holiday season, and Kinect bundles can be found everywhere. There are also four times as many Kinect games out now as last year, plus a new Xbox dashboard is scheduled for December 6. By the end of the year, the console will also begin its imitation of a cable box, as multiple cable channels will be available through it (the packages will be dependent on the cable provider).

So far it is looking like the holiday season may help save an otherwise lackluster year for gaming. We just need to wait to see what the PlayStation sales look like. No pressure, Sony, no pressure.

War has never looked cuter than in this Lego Call of Duty spoof (Yahoo! News)

Call of Duty: Modern Warfare 3 is one of the best-selling video games of all time. It broke launch-day sales records without even batting an eyelash, and will undoubtedly be found under millions of trees across the country this holiday. So how could you make an already fantastic video game even better? By adding Lego, of course!

The video is the latest in a line of Lego spoofs that has been a big hit on YouTube and other video sites, and it shows just how adorable war can be. Its directors at Kooberz Studios took every frame of the much-hyped Modern Warfare 3 launch trailer and gave it a Lego twist. They kept the soundtrack in tact to add to the epic action that is now presented entirely in plastic.

Trinidad "plot" arrests reach 13, but details scarce (Reuters)

PORT OF SPAIN (Reuters) ? The number of suspects detained in an alleged plot to assassinate Trinidad and Tobago's prime minister rose to 13, a top security official said on Monday while offering few new details about the conspiracy.

National Security Minister John Sandy faced intense questioning at a news conference from reporters pressing for more specifics since Prime Minister Kamla Persad-Bissessar announced on Thursday that officials had uncovered a plot.

The government's vague announcement and reluctance to provide more information has puzzled many in this twin-island Caribbean country, a leading oil and gas producer and the top supplier of liquefied natural gas to the United States.

Sandy said a total of 13 people had been detained in connection with the alleged assassination plot, including a police officer, two former police officers and an ex-Coast Guard member. Last week, police said nearly a dozen people had been rounded up.

None of the detainees have been shown publicly and officials have not said what evidence led to the arrests.

"What we have unearthed is real," Sandy said, but he gave no new information about the possible motives for the alleged conspiracy to assassinate the prime minister.

Persad-Bissessar, a former attorney general, said on Thursday the plot targeted her and three cabinet ministers.

She called it a planned reprisal by criminals angry over a state of emergency she declared three months ago to crack down on drug-related crime and gang activity in Trinidad and Tobago.

Sandy said Persad-Bissessar's decision to go public with the news that authorities had uncovered the plot was "because a lot of rumors were flying ... about a coup and things like that."

SURGING CRIME, FALTERING ECONOMY

But opposition figures have strongly questioned the government's assertion that a plot existed, saying the prime minister wants to use it as a pretext to extend the state of emergency, which is set to expire on December 5.

"The government ... has come up with this story about an assassination plot, which cannot stand public scrutiny," opposition leader Keith Rowley said.

"The government's action is hysterical, political expediency," he added in comments published over the weekend.

Many ordinary Trinidadians have also expressed doubt, suggesting Persad-Bissessar may be trying to shore up political support at a time when her government has been struggling to revive a faltering economy.

Trinidad and Tobago has been seeking to attract fresh foreign investors, especially in the strategic energy sector.

In declaring the anti-crime emergency in August, Persad-Bissessar cited a surge in murders and other violent activity linked to the drugs trade.

Located just seven miles off the coast of Venezuela, Trinidad and Tobago has become a trans-shipment point for South American drugs headed to Europe and the United States.

Sandy appeared to suggest drug activity was proving an increasing problem for the government.

"I think we need to take cognizance of the fact that Trinidad and Tobago, because of where we sit geographically, has lent itself to a number of issues," he said. "I think we need to be a bit more serious about some of the things that happen around us."

Report claims coverup in Russian lawyer's death (AP)

MOSCOW ? A new report claims a Russian lawyer who died in prison was tortured and deliberately denied medical treatment, and that the official investigation covered it up.

Sergei Magnitsky, who was arrested after accusing officials of corruption, died in November 2009 after the pancreatitis he developed in prison went untreated. Two prison doctors have been charged with negligence.

The 37-year-old had been arrested by the same Interior Ministry officials whom he had accused of using false tax papers to steal $230 million from the state.

The report released Monday was compiled by William Browder, a U.S.-born investor who owned and run Hermitage Capital Management, the investment fund where Magnitsky worked before his arrest.

Browder's report claims that the official probe that led to the negligence charges covered up the roles of other officials in Magnitsky's death.

Stanford Beats Notre Dame: Andrew Luck Bolsters Heisman Campaign in 28-14 Win

STANFORD, Calif. ? Andrew Luck set the school record for the most career touchdown passes and eclipsed his own single-season mark, throwing for 233 yards and four scores to lead fourth-ranked Stanford past No. 22 Notre Dame 28-14 in his home finale Saturday night.

Luck topped John Elway's record of 77 touchdown passes and helped the Cardinal (11-1) build a 21-0 halftime lead. He has thrown for 80 touchdowns in three years and 35 this season.

Tommy Rees threw an interception, lost a fumble and took a bruising blow to the ribs for Notre Dame (8-4) before getting benched. Andrew Hendrix threw for 192 yards and a touchdown and ran for another score in a second-half rally for the Fighting Irish that came up short.

It wasn't the prettiest performance of Luck's brilliant college career.

Still, he earned a rare place in Stanford history.

The victory likely vaulted Stanford into an at-large BCS bowl bid for the second straight year ? with the Fiesta Bowl among the leading possible destinations ? but the program will not play for a major championship this season. The lone loss to Oregon put the Ducks in the Pac-12 title game out of the North Division and crushed the Cardinal's dreams of a national title.

Only another weekend of chaos at the top would've reversed course.

Stanford coach David Shaw shined the spotlight on his program and his quarterback's Heisman Trophy campaign with a calculated rip of the "flawed" BCS system this week. The Cardinal's play matched his words for 30 minutes.

For a while, though, it looked like a sloppy second half just might undo everything Stanford had worked for.

Notre Dame coach Brian Kelly benched Rees in favor of Hendrix to start the third quarter, and the move pumped some life into a stagnant Irish offense.

Notre Dame took advantage of pass interference and roughing the passer penalties for its first score. Hendrix threw a 6-yard TD to Michael Floyd to slice Stanford's lead to 21-7 halfway through the third quarter. Floyd finished with 94 catches on the year, breaking the single-season mark of 93 set by Golden Tate in 2009.

The Irish were driving for another score when Hendrix overthrew a receiver, the ball was tipped and intercepted by Michael Thomas. When Notre Dame regained possession, Hendrix was sacked by A.J. Tarpley for a 13-yard loss that sent another drive tumbling.

Only room for one quarterback to steal the show.

Luck quickly connected with Coby Fleener for a 55-yard TD pass to extend Stanford's lead to 28-7 with 5:40 remaining to put the game out of reach. Fleener also caught a 28-yard TD in the first half that gave Luck every major school touchdown record.

Stanford's Senior Day belonged to the redshirt junior.

Luck lobbed a fade to the short corner of the end zone to complete a 3-yard score to Levine Toilolo, giving Stanford a 7-0 lead in the first quarter. Even he had to hold back a smile running to the sideline to a swarm of well-wishes from teammates for the records-tying toss.

But Luck lost his rhythm when a back-side blitzer closed the pocket, and he tossed a short pass that Darius Fleming intercepted and returned 35 yards. Notre Dame took over at the Stanford 10 after a 15-yard penalty on Fleener for a horse collar.

Stanford stifled the Irish on consecutive plays and forced a 20-yard field goal that David Ruffer missed wide right. No luck for the Irish on this night.

The only Luck belonged to Stanford.

He followed with a 28-yard TD pass to Fleener. The tight end dragged cornerback Robert Blanton the final 10 yards into the end zone, sealing Luck's marks in the school record book.

With the clock dwindling down before the half, Corey Gatewood intercepted a pass from Rees and handed Luck and the offense the ball with 1:38 left. Luck led a 10-play, 64-yard drive capped by an 11-yard TD pass to Ty Mongtomery with 10 seconds left to extend the Cardinal's lead to 21-0.

(AP) ? Matt Leinart's return to the NFL lasted less than a half, and coach Gary Kubiak says the Texans will sign another quarterback this week. Perhaps even Brett Favre will be in the mix.

Leinart will be placed on injured reserve after fracturing his left collarbone in the second quarter of Houston's 20-13 win in Jacksonville on Sunday.

The left-handed Leinart was making his first start since 2009 in place of Matt Schaub, who broke a bone in his right foot in the Texans' 37-9 win in Tampa Bay on Nov. 13.

Kubiak says Leinart will have surgery within the next week, and Schaub is due to have surgery on Wednesday to repair a Lisfranc injury.

Kubiak says Houston will try out other quarterbacks this week and hinted the 42-year-old Favre, who retired in January after 20 seasons, could be considered.

"I don't think you rule out anybody," Kubiak said when asked about Favre specifically. "There are a lot of names being mentioned. We've got to continue to work through the process.

"I'm not going to rule out anybody, nor confirm anybody."

Favre's agent, Bus Cook, said late Monday the Texans have not contacted him about Favre.

"I've been a little bit part coach, part counselor here the last couple of weeks," Kubiak said. "I've got Schaub in my office all day last Monday and today I've got Lefty (Leinart) up there. It's just difficult. It's difficult for both of them."

Despite losing one key player after another, Houston (8-3) has won a franchise-record five straight games. Rookie T.J. Yates, a fifth-round draft pick out of North Carolina, will start Sunday's game against Atlanta (7-4). Kellen Clemens, signed last week, will back him up.

Clemens was one of five quarterbacks to try out last Tuesday in the wake of Schaub's injury. Kubiak spent much of Monday discussing all the options.

"When that will happen, I don't know," Kubiak said. "My focus now is strictly with T.J. and Kellen, and moving forward with Atlanta."

Brodie Croyle, Jeff Garcia, Trent Edwards and former Rice quarterback Chase Clement worked out last Tuesday. Clemens had an automatic edge because he spent training camp with Washington, former Kubiak mentor Mike Shanahan and former Texans offensive coordinator Kyle Shanahan.

"I have an opinion on those guys," Kubiak said. "There are some other names that are going to come up in the next day or so. We'll just have to sort it all out."

The 6-foot-3 Yates, a record-setting quarterback for the Tar Heels, went 8 for 15 for 70 yards in place of Leinart on Sunday. Kubiak says he kept the play calls simple for Yates.

"What he had to go do is not easy to do," Kubiak said.

When the Texans drafted Yates, Kubiak compared him to Schaub with his skill set and knack for understanding the game.

He was also attractive to Houston because he ran a similar offense at North Carolina, where he set the school records for yards passing in a career (9,377) and a season (3,418). The Tar Heels' offensive coordinator was John Shoop, who worked on staffs with the Chicago Bears and Oakland Raiders, among other teams.

"He had a lot of things going for him when he stepped in the NFL, as far as how he had been taught," Kubiak said. "He plays the game fast, you have to play fast in this league. You have to be able to get rid of the ball, you have to be able to move.

"He's got those things going for him," Kubiak said. "Now it's just a matter of a ton of reps and we'll see how much progress he can make."

It certainly helps that Yates has the league's best defense and one of its most productive running games supporting him. The Texans gave up only 151 yards in the second half Sunday to preserve their lead.

"Well, the whole group's impressive right now," Kubiak said of the top-ranked defense, yielding 268.4 yards per game. "They're just playing very, very hard. The thing that's most impressive, I use the word 'group' because everybody's making plays. It's contagious."

Houston rushed for only 88 yards in Jacksonville, its second-lowest total of the season, and Kubiak blamed his conservative play-calling for the struggles.

"I don't know if I put our guys in great position," Kubiak said. "I was concerned having one quarterback out there, and making sure that I was trying to find a way to win the game that day. I don't like some of the things I did. We played hard. We just didn't play very good offensively in the second half."

Protests against military rule cloud Egypt election (Reuters)

CAIRO (Reuters) ? Protesters rallied again in Cairo's Tahrir Square on Sunday to try to evict the generals who replaced Hosni Mubarak, in a trial of strength that has muddied the run-up to Egypt's first vote since a popular revolt deposed the former leader.

The parliamentary election that gets under way on Monday and Tuesday is the first step on the ruling army council's timetable toward a transfer to civilian rule, now promised for July.

Some Egyptians yearn for stability after a week of bloodshed that has killed 42 people and wounded over 2,000, preferring for now to let the generals run a nation whose prolonged political turmoil has thrust the economy deeper into crisis.

But the demonstrators want the council to make way for a civilian interim administration immediately. They reject its choice of 78-year-old Kamal Ganzouri to form the next cabinet.

Activists had called for a mass rally in Tahrir to pile pressure on the generals, and by mid-afternoon there were thousands in the square, hub of the unrest that toppled Mubarak.

Field Marshal Mohamed Hussein Tantawi, head of the council, said the army would ensure security at the polling booths.

"We are at a crossroads. There are only two routes, the success of elections leading Egypt toward safety or facing dangerous hurdles that we in the armed forces, as part of the Egyptian people, will not allow," he declared.

Abdel Moneim Aboul Futuh, an Islamist presidential candidate who opposes military rule, said: "The nation is larger than Field Marshal Tantawi and Lieutenant General Sami Enan and the military council. A government with revolutionary leadership must be formed to meet the demands of Tahrir Square."

State television quoted Tantawi as saying the army's role in the new constitution would be unchanged: to protect the nation.

The outgoing cabinet angered many Egyptians by floating proposals that would have given the army sweeping national security powers and protected it from civilian scrutiny.

The generals have received tacit support from Islamist parties eager that nothing should disrupt voting in the first of three rounds of an election in which they expect to do well.

GANZOURI'S RECORD

Bassam Sharaf, among protesters outside parliament, said the objection to Ganzouri was not his age, but the policies he pursued as prime minister under Mubarak from 1996 to 1999.

"Two-thirds of the ministers that Ganzouri appointed in his day are now in Tora prison," he said, referring to Mubarak-era officials accused of corruption and other offences who were put on trial after an uprising swept Mubarak from power in February.

Alarmed by Egypt's latest bout of unrest, the United States and the European Union have condemned the "excessive force" used by the authorities and urged a swift handover to civilian rule.

Some protesters favor Mohamed ElBaradei, former head of the U.N. nuclear watchdog, who has offered to drop his campaign for the presidency and to lead a government of national unity.

ElBaradei is respected among pro-democracy campaigners and has a high international profile, but many Egyptians view him as out of touch because he spent much of his career abroad.

MUSLIM BROTHERHOOD

Mohamed Badie, leader of the once-banned Muslim Brotherhood, which hopes the election will catapult it into a strong place in mainstream politics, offered Ganzouri qualified support, depending on the powers and makeup of his cabinet.

He suggested conspiratorial hands were behind the unrest. "There are powers inside and outside Egypt that don't want stability for Egypt or development, and this is something that is being pushed and paid for," he said late on Saturday.

Al-Gama'a al-Islamiya group, which has now renounced violence but led an armed insurgency against Mubarak during Ganzouri's government in the 1990s, said it would not join the protesters in Tahrir, criticizing them for trying to "force a certain prime minister on Egypt," a reference to ElBaradei.

The Salafi Islamist Nour Party said it would meet Ganzouri in the next few days to propose names for his cabinet.

Protesters appear split over the election. Some do not trust the military to ensure a free vote. Others say the poll should not be a casualty of the campaign against military rule.

"This is one thing, that is something else. Everyone will be in the polling stations come Monday," said Abdul Aal Diab, a 46-year-old state employee protesting in Tahrir.

"Why are you so sure?" interrupted Mustafa Essam, 27. "I won't go. I have no faith in anyone."

Groups chanted slogans against the generals in Tahrir as people wandered among banners, tents and tea stalls with chairs and tables that lent the protest an air of permanence.

The complex, drawn-out election to parliament's lower house concludes in early January. Voting for the upper house and the presidency will follow before the end of June. A confusing array of candidates and parties, and fears of bullying, bribery and violence at polling stations set voters a daunting challenge.

Ahmed Abdul Fattah, 40, said he would vote for the moderate Islamist Wasat Party, but with no enthusiasm for what he said were poorly timed elections. "Why should we have them? So the Muslim Brotherhood can dominate us?" he asked.

Rising Hegemon: Investing in Mars

The credit agencies have been busy with a new round of threats.? Here's one:

Standard & Poor?s said Japanese Prime Minister Yoshihiko Noda?s administration hasn?t made progress in tackling the public debt burden, an indication it may be preparing to lower the nation?s sovereign grade.

And another:
Portugal suffered a double blow Thursday after Fitch Ratings downgraded its debt to junk

And yet another:


Moody's Investors Services warns it could downgrade the U.S. government's top credit rating if Congress backs off $1.2 trillion US in automatic deficit cuts scheduled over the next decade.

I do believe the world's credit agencies are readying their escape pods and are preparing to escape the gravity of the Earth they've helped create.
