Calif. Legislature Passes Major LTC Insurance Reform Bill

SACRAMENTO, Calif., Aug. 31 -- The California Department of Insurance issued the following news release:

Insurance Commissioner Dave Jones today announced that the California State Legislature has passed AB 999, authored by Assembly Aging and Long-Term Care Committee Chair Mariko Yamada (D-Davis). The bill, sponsored by Commissioner Jones and the California Department of Insurance, protects consumers from excessive premium rate volatility by modifying the long-term care insurance (LTC) premium rate development process. The measure also allows consumers to make more informed decisions about buying a policy by giving them the chance to review language before purchasing one.

"The rising cost of long-term care insurance is one of the most pressing issues facing senior consumers today," said Commissioner Jones. "What's most disturbing is the size of long-term care rate increases. They threaten the ability of many seniors, especially those on fixed incomes, to maintain or purchase long-term care insurance. AB 999 provides for additional transparency and protections related to long-term care insurance rate increases. I want to thank Assembly Member Mariko Yamada for her leadership in carrying this legislation."

"AB 999 brings needed transparency to the long-term care insurance market and strengthens the Insurance Commissioner's authority to protect consumers from the excessive premium rate hikes that have long plagued the industry," said Assembly Member Yamada. "On behalf of thousands of current policyholders, and millions of California's "seniors-in-waiting", I applaud Insurance Commissioner Dave Jones for sponsoring this legislation."

Long-term care insurance was first sold in California in the early 1980's. Since it was a new product, insurers had no historical experience upon which to rely when setting initial premium rates. As a result, pricing of LTC policies was often based upon what were later found to be inaccurate assumptions. As insurers gained more experience in the market, premium rates increase to compensate for those initial inaccuracies.

In 2000, the Legislature passed SB 898 to stabilize what became escalating rates. However, the rate stabilization features passed years before are not completely restoring predictability as intended to the long-term care insurance market today. Among other things, AB 999 would prevent insurers from passing poor investment returns through to taxpayers and eliminate the practice of insurers "cherry-picking" a small group of policies to justify large rate increases, among other strong consumer protections.

"I urge Governor Jerry Brown to sign this necessary legislation aimed at protecting California's seniors," said Commissioner Jones.

Remnants of Isaac will turn eastward Saturday and move over the Midwest into the Ohio River Valley. This storm system will continue pulling abundant moisture in from the Gulf of Mexico, spreading heavy rains and strong thunderstorms across the mid-Mississippi River valley and Ohio River valley. There is a slight chance of severe weather developing with strong winds and large hail across the region.

The heaviest rainfall is expected to move across Missouri and into Illinois on Saturday afternoon and into the evening hours. Rainfall totals will range from 3 to 4 inches with higher amounts possible in some areas. Lighter and more widespread showers will stretch from eastern Kansas and Oklahoma, into Ohio and West Virginia.

Elsewhere in the nation, a low pressure trough over the Northern Rockies will begin to advance eastward, pushing a front into the high Plains and northern Plains. This will bring a slight chance of thunderstorm activity to the region.

Meanwhile, monsoonal moisture will linger over the Southwest and the Rockies, maintaining chances of afternoon showers and thunderstorms. To the south, Hurricane Ileana is expected to drop to a tropical storm on Saturday with winds between 39 and 73 mph as it continues spinning northwestward over the Pacific away from Mexico's Baja California region. Moisture associated with this system will make its way north up the West Coast, increasing clouds and chances of showers for far northwestern Mexico and extreme southern California.

Temperatures in the lower 48 states ranged Friday from a morning low of 30 degrees at Stanley, Idaho, to a high of 102 at Del Rio, Texas.

Maine case worker blames sitter for baby's death

PORTLAND, Maine (AP) ? Maine's child welfare agency is placing blame for a baby's death on the mother of a 10-year-old accused of killing her, saying the mother shouldn't have left the infant with the girl and the baby's death was "a result of your neglect."

A case worker faulted the sitter for leaving the baby in her 10-year-old daughter's bedroom in the central Maine town of Fairfield. In a letter, the case worker said the girl had a behavior disorder that made her unsuitable for caring for the infant.

The 10-year-old girl was charged this week with manslaughter in the death of 3-month-old Brooklyn Foss-Greenaway of Clinton in a case that shocked the state because of the homicide suspect's tender age.

The mother, who has not been charged, declined to speak to The Associated Press on Friday. She referred the AP to her lawyer. No one answered her lawyer's office phone during business hours.

A roommate who was in the Fairfield house early on July 8 when Brooklyn died told the AP that the baby was sleeping in the girl's room and that she heard occasional crying from the bedroom before chaos erupted.

Ashley Tenney said she was awakened by a commotion and went upstairs to see a terrified look on the girl's face as the mother performed CPR on the baby.

"I was unsure what was going on because I was half asleep. I heard a lot of crying and screaming, and I heard the word 'dead,'" said Tenney, who has since moved out.

Both Tenney and Brooklyn's mother, Nicole "Nicki" Greenaway of Clinton, said the sitter should be held accountable for leaving the baby with the 10-year-old.

Since the infant's death, the 10-year-old was placed in the custody of the Department of Health and Human Services.

Christopher Filteau, a department case worker, said in a letter to the sitter that she made mistakes. The letter was first reported by the Kennebec Journal. The AP obtained a copy of the letter.

"You neglected to provide the proper level of supervision by allowing Brooklyn to remain in (the girl's) care," the case worker wrote on Aug. 10. "Brooklyn Foss-Greenaway has died as a result of your neglect."

The Associated Press is not naming the sitter because it could make known the juvenile suspect's identity.

The letter also says the girl has "attention deficit hyperactivity disorder," ''oppositional defiant disorder" and "attachment disorder."

The woman has a right to appeal the state agency's findings, but it is unclear if she intends to do so. A DHHS spokeswoman declined comment Friday.

For now, the criminal investigation is focused on the actions of the girl, not her mother, said Stephen McCausland, spokesman for the Maine Department of Public Safety. A lawyer representing the girl declined to comment Friday.

Deputy Attorney General Bill Stokes said the girl is the youngest homicide suspect in his 35 years as a state prosecutor, and he said there will be no effort to have her tried in the state's adult court system.

More information will be filed in conjunction with the girl's first appearance in October in juvenile court, where the maximum penalty for a conviction is incarceration until age 21.

"The juvenile justice system is designed to hold people accountable but to deal with young offenders in a way that prevents future occurrences and gets them the help they need. That's the focus we'll be driving at," he said.

In Fairfield, 70 miles north of Portland, neighbors had nothing bad to say about the baby sitter or her children, who live in a tidy white house.

"She's very pleasant, not a neighborhood disruptor or anything like that," said neighbor Jon Cochran, who lives across the street. He called them "a regular family."

U.S. military?s F-35 not landing in Hawaii

The military may be shifting its focus to the Pacific, but even with that new direction and Hawaii?s strategic location, the Pentagon has no plans to base F-35 Joint Strike Fighters here.

One source familiar with all the aircraft-related work at Marine Corps Base Hawaii told me they heard the base could get the aircraft. But the Marines at the Pentagon said there are no plans to put the aircraft in Hawaii, and a National Guard official familiar with Joint Base Pearl Harbor-Hickam told me he hasn?t heard anything about the Navy and Air Force putting any F-35s there either.

Pearl Harbor-Hickam already has F-22 Raptor stealth fighters that the National Guard shares with the Air Force.

And military experts I talked to said it would also make sense to put F-35s here. It would probably mean big business for contractors since the aircraft would need hangars, simulator training centers and other facilities. Just look at the hundreds of millions of dollars the Marines are going to spend at MCB Hawaii to base MV-22 Osprey and helicopters there.

?It makes sense to put [F-35s] in Hawaii because it puts them closer to China, so to speak,? Francois Boo, an associate and military expert with GlobalSecurity.org, told me in an email.

With that said, it?s kind of a head scratcher that the Marines are putting some of these aircraft ? which have been plagued with problems while they are still being developed ? in Yuma, Ariz., instead of on U.S. soil in the Pacific.
