Federal court upholds S.D. abortion suicide advisory

A federal appeals court has upheld a portion of a 2005 South Dakota law that requires a doctor to tell a woman seeking an abortion that she faces an increased risk of suicide.
In a 7-4 opinion on Tuesday, the 8th Circuit Court of Appeals said medical research has shown that the risk of suicide is higher for women who abort compared with women who don?t.
?The statute does not require the physician to disclose that a causal link between abortion and suicide has been proved.? The disclosure is truthful, as evidenced by a multitude of studies published in peer-reviewed medical journals that found an increased risk of suicide for women who had received abortions compared to women who gave birth, miscarried, or never became pregnant,? the opinion said.
?Various studies found this correlation to hold even when controlling for the effects? of other? potential? causal factors? for? suicide,? including? pre-existing depression, anxiety, suicide ideation, childhood sexual abuse, physical abuse, child neuroticism, and low self-esteem.?
The appeals court said the suicide advisory is ?non-misleading? and ?relevant to the patient?s decision to have an abortion.?

The ruling came in a lawsuit filed by Planned Parenthood Minnesota, North Dakota, South Dakota against former South Dakota Gov. Mike Rounds and Attorney General Marty J. Jackley.
The full appellate panel agreed to rehear the case after a three-judge panel upheld U.S. District Judge Karen Schreier's decision to overturn the requirement, The Associated Press reported.?The decision by the full 11-member court vacates the permanent injunction against enforcing the provision, according to the AP.

"On its face, the suicide advisory presents neither an undue burden on abortion rights nor a violation of physicians? free speech rights," the decision said. ?
Planned Parenthood Minnesota, North Dakota, South Dakota took issue with the appeals court decision, saying it "allows the greatest intrusion by the government into the patient doctor relationship to date."
"The bottom line is that women don?t turn to politicians for advice about mammograms, prenatal care, or cancer treatments. Politicians should not be involved in a woman?s personal medical decisions about her pregnancy," Planned Parenthood said in a statement.
Leslee Unruh of the Alpha Center pregnancy counseling center in Sioux Falls, which seeks to persuade women not to seek abortions, called the decision a victory for South Dakota women.
?We are thrilled. This has been a long time working from 2005. It?s a long, long haul. We are so excited for the women of South Dakota that they have this victory,? she told the AP.
The suicide advisory was part of a larger 2005 law requiring South Dakota doctors to provide women with certain information before an abortion can be voluntary.
Still entangled in the courts are two sections of a separate 2011-12 law?dealing?with a 72-hour waiting period for abortions and requirements for "pregnancy help centers," Jackley said.

Why Copyright Is Evil
Copyright is dying ? that is obvious to everyone. What isn?t obvious to everyone, especially in the music industry, is what a glorious and just outcome this is.
International copyright only came into being in 1891 ? very recent considering the long history of music and the arts. And it was publishers ??not?artists ? who convinced governments to foist the system on us. Prior to that, during monarchical times ?copyright? was permission granted to writers by the king to print what was politically correct. It was government that introduced the entire concept of ?idea ownership? ? the basis of copyrights and patents ? precisely so it could crush the ideas it didn?t like. Copyright has rotten origins.
So Why is it Evil?
We must first understand what property is, since copyright is based on the notion that ideas are property.
Property begins with one?s ownership of one?s body, and extends to all the resources one acquires through
- Trade (i.e. buying and selling)
- Manual labor (i.e. creation)
- Homesteading (aka ?squatting? on a resource no one had yet claimed)
This can mean simply the clothes on your back, or a small ranch house in the suburbs on a quarter acre or, like Bill Gates, a 40% share in a $70 billion company. They?re all property.
The one thing all physical property has in common is?scarcity. Dirt, houses, livestock animals, software companies ? they?re all made up of physical matter that is in limited supply. How limited is relative ? obviously a pound of dirt is much less scarce than a huge software company. That?s why their market prices are so different. But there?s a reason that, for example, air and light are free: they are not scarce at all and require no human?labor to produce.
Scarcity is not some esoteric concept ? it?s at the core of most economic theories. Economists and law philosophers write about it and its role in prices, competition, entrepreneurship and a host of other areas. Scarcity is a basic reality of existence in human society.
Ideas as ?Property?
Now consider ideas and artistic works. A CD recording of a performance is obviously a scarce physical commodity ? it takes resource and labor to record and manufacture. But that?s not why CDs used to cost $20+ back in the 1990s. They cost that much because of the copyrighted sounds ? that is,?ideas?? imprinted on the discs. This is also why most CDs these days cost around $10 ? because copyright is in the latter stages of decay, due to competition from other media. The cost of a CD is falling back toward the actual cost (plus markup) of the scarce, plastic piece of physical?property that it is.
But the law still says that the CD?contents?? the ideas imprinted on it ? are copyrighted. This essentially means that the CD is not wholly your property, like a pound of dirt, or a painting, or a company is if you own these things. Copyright puts the CD owner in a bizarre circumstance where the original publisher retains some ownership of?your?CD even after you?ve paid your $10-20 for it.
But the musical ideas on the CD are not scarce. If I share the ideas with my friends by playing them the CD, the original owner hasn?t lost his own copy of them. I haven?t ?stolen? anything from him. Like air and water molecules, the sound waves that make up a musical performance are in such great supply that no one is made poorer if they are replicated ad infinitum.
Therefore, musical ideas in their raw form of pure sound ? fail the test of true property. They therefore cannot be ?owned?, and sharing them or even re-selling copies of them in different media cannot be considered theft or fraud. It may still be illegal to do so, but that only makes copyright one of the thousands of?illegitimate?sausage laws?that clog the statutes and unjustly limit our liberty. And as we?ve seen in the last 15 years, the only way to sustain copyright enforcement in an era of disruptive technology is to erect a large and?oppressive government apparatus.
This is why the institution of copyright is evil ? it thwarts true law (property and ownership), and requires jackboot tactics to enforce.
So What?s a Musician To Do?
So if modern copyright is only 121 years old, how on earth did Bach, Beethoven & Brahms survive and thrive without it?
It?s easy to understand ? just look around you now.
The music industry today is going back to the future ? like Beethoven, artists are now surviving by hustling the old fashioned way: boot-strapping public performances and touring. Or, like Bach, they?re subsidizing their song-writing passion by taking side-jobs at the local church or school. Of course, they?re also getting creative and using today?s amazing technology to implement the business models like?Connect-With-Fans+Reason-To-Buy.
Can musicians sit back and collect royalties and a share of the huge monopoly profits of yesteryear? Nope. But, those were the days of the golden handcuffs and the chosen few. The only artists who whine and complain now about those ?good old? days are either
- Old artists who came up in the old days and are wistful of the time when they only had to record an album every three years to earn 5 times what they earn now, or
- Young artists who are too lazy to boot-strap things themselves and wish success was handed to them
But as Seth Godin has proved, these days you have to?choose yourself?to make your own success.
I encourage musicians to read up more on this topic ? all you need to do is google ?against copyright? and similar terms to begin the journey to a more common-sense philosophy on this subject that is so close to musicians? hearts and wallets.

Dream wedding donated to military bride
Cumming, Ga. -- Bride-to-be Amanda Jude was ok with it, but not exactly overjoyed. After time and budget constraints had her planning a courthouse wedding, she suddenly had a flood of good fortune. It started when she called her cake-maker to tell her not to worry about it; Jude said she didn't have a need for the cake. Her fianc? was only going to be on leave for a few days from his base in Louisiana, and they didn't have the money to stage a big event.
"She said she'd see what she could do,'" Jude remembered hearing from Natalie Roth. "I was like, 'See what you can do?' and before I knew it she had a florist involved, she got venders involved, she got catering done and photography, and I was like, 'Wow.'"
Roth said she made no promises in the beginning, but a lot of phone calls.
"I was just hoping she would have a place where she could eat cake, and then it branched into we can have flowers for the cake so let me call a florist," Roth said. "We just called and people said yes, I mean it was really, really easy to get people to help, because people want to support our troops."
Amanda and her fianc? Brian even got wedding rings, and the ceremony will take place at the Four Oaks Manor in Buford on August 12th-free of charge of course.
Roth is now trying to launch a project like this once a year, calling it Weddings for Warriors. And Jude is looking forward to creating memories that will sustain her through her fianc?'s second deployment to Afghanistan next year.
"It's the worst feeling not to talk to someone that you're used to talking to every day," Jude said. "But having the pictures all over the house will help because I know that he's going to be ok, I know that he's coming home, and I'm going to spend the rest of my life with him. That makes me really excited."

Adopt A Block program brings church help to poor communities

PALMETTO - Members from local churches are changing the reality of poor communities one Saturday at a time.
Every week volunteers cook pancakes and hand out clothes, food, baby formula and other necessities to residents from struggling neighborhoods.
The program, dubbed Adopt A Block, also works on cleanup projects. The program's outreach assistant, Nicky Brending said that when they first started working in the Oakridge Apartments this spring there was trash everywhere. Now the apartments are nearly spotless.
"We pick up trash every Saturday but we really encourage them to pick up their own trash," Brending said. "It is really making a difference."
The program also offers English classes and provides information on health care.
Building trust and relationships is also a big part of this program, said Bayside Church members Nancy and Juan Morales.
On Saturday's area children begin lining up before the doors even open, and often help the volunteers set up.
The program also organizes a soccer league and helps provide uniforms and trophies.
Five churches partner for the Adopt A Block program: First Baptist Church of Palmetto, North River Church, Sarasota Baptist Church, Bayside Community Church and Mt. Carmel Church in Palmetto.
The program currently serves residents of Oakridge Apartments and in the 400 block of 11th Street Drive, but organizers hope to expand it.
Volunteer Nancy Morales said Adopt A Block goes beyond just feeding and clothing people.
"I see some people starting to take charge of their lives," she said. "People that before were so quiet, now are starting to speak for themselves."
Trina Hernandez has lived in the Oakridge Apartments for 18 years and said the Adopt A Block program has transformed the community.
"Thank you for always coming here," Hernandez says in Spanish to Nancy Morales.
The program has also been inspirational to the volunteers.
Dylan Cunard, 10, said that watching his father, Kel Cunard, help out every Saturday has changed his young life.
"I saw my dad coming here every Saturday and I decided to come with him," Dylan said. "I see all these kids that have nothing and I can help them."
Dylan said he has been so touched by the experience that he is planning to go to Haiti this summer and help children there. He will work in a bible school for children and install water collection and purification systems on homes.
"I'm looking forward to helping people in need and to sharing the love of Jesus with the kids we meet," Dylan said. "I want to pass this experience on to my kids someday because I want them to know what it feels like to help someone."
